There are still many Indonesians who think that conflicts can only be solved through court processes. In fact, a conflict can also be resolved out of court (non-litigation). The Law Study Program, President University (PresUniv) discussed this through a webinar entitled Advocacy Outside the Indonesian Courts, on Friday (23/4). This topic was presented by Alghiffari Aqsa, S.H., Managing Partner at AMAR Law Firm and Public Interest Law Office, and guided by Handa S. Abidin, S.H., LL.M., Ph.D., Lecturer in Law Study Program, PresUniv.

At the beginning of the webinar, Handa explained that resolving conflicts does not only have to go through a court process (litigation). There are many institutions that can help resolve conflicts, such as Komnas HAM, Komnas Perempuan, the Ombudsman, or even the Ministry. Explaining further, Alghiffari said that in terms of method, conflicts could be resolved legally and non-legally, such as through the media, civil society organizations, etc. He also revealed that the most effective and qualified way for a lawyer is not even appearing in court. This is because a lawyer must solve problems quickly and effectively, where the court process takes longer.

There are many ways in advocacy for non-litigation, such as mediation, negotiation, arbitration, correspondence, petitions, campaigns, non-violent protests, and urgent appeal. In addition, non-litigation is also cheaper, effective, comprehensive, and is a stage before litigation. This is why conflict resolution is better through non-litigation in advance. Moreover, Alghiffari also revealed that lawyers need to work closely with the media and use their help, but with the client's consent. However, it should be noted that lawyers should not use cases for popularity. "It violates the ethics of lawyers," he stressed. Other lawyers' ethics that he explained, which are lawyers are required to provide solutions, are independent and not employees of the client, are honest with the process, and only serve one side. Non-Litigasi: Advokasi yang lebih Efektif

 

Masih banyak masyarakat Indonesia yang menganggap bahwa penyelesaian sengketa hanya dapat dilakukan melalui proses pengadilan. Faktanya, sebuah sengketa juga dapat diselesaikan di luar pengadilan (non-litigasi). Hal inilah yang dibahas oleh Program Studi Hukum, President University (PresUniv) melalui webinar berjudul Advocacy Outside the Indonesian Courts, pada Jumat, (23/4). Topik ini dibawakan oleh Alghiffari Aqsa, S.H., Managing Partner di AMAR Law Firm dan Public Interest Law Office, dan dipandu oleh Handa S. Abidin, S.H., LL.M., Ph.D., Dosen Prodi Hukum, PresUniv.

Di awal webinar, Handa menjelaskan bahwa menyelesaikan sengketa tidak melulu harus melalui proses pengadilan (litigasi). Ada banyak lembaga yang dapat membantu menyelesaikan sengketa, seperti Komnas HAM, Komnas Perempuan, Ombudsman, atau bahkan Kementrian. Menjelaskan lebih lanjut, Alghiffari mengatakan bahwa dari aspek cara, sengketa dapat diselesaikan secara Hukum dan non-hukum, seperti melalui media, organisasi masyarakat sipil, dll. Ia pun mengungkapkan bahwa cara yang paling efektif dan mumpuni untuk seorang pengacara malahan bukan muncul di persidangan. Hal ini karena seorang pengacara harus bisa menyelesaikan masalah dengan cepat dan efektiv, dimana proses pengadilan malahan memakan waktu yang lebih lama dan lebih panjang.

Dalam advokasi sendiri, ada banyak cara yang dapat ditempuh untuk non-litigasi, seperti mediasi, negosiasi, arbitrase, korespondensi, petisi, kampanye, protes tanpa kekerasan, dan seruan mendesak. Selain aspek caranya yang banyak, non-litigasi juga lebih murah, efektif, komprehensif, dan merupakan satu tahap sebelum litigasi. Inilah mengapa penyelesaian sengketa lebih baik melalui non-litigasi terlebih dahulu. Di samping itu, Alghiffari juga mengungkapkan bahwa pengacara perlu bekerja cukup dekat dengan media, dan menggunakan bantuannya, tapi dengan persetujuan client. Akan tetapi perlu diperhatikan bahwa pengacara tidak boleh menggunakan kasus untuk popularitas. “Itu melanggar etika pengacara,” tegasnya. Etika pengacara lainnya yang ia paparkan, yaitu pengacara wajib memberikan solusi, mandiri dan bukan karyawan dari client, jujur terhadap proses, dan hanya melayani satu sisi. (Silvia Desi Betrice.
