Sunday, 20 October 2019, during his inauguration speech, President Joko Widodo (Jokowi) revealed a “new” initiative to form the omnibus law. In fact, the omnibus law is not just a name, but a method of forming a regulation. To understand more about this method, the Law Study Program, President University (PresUniv), held a webinar "Omnibus Law sebagai Metode Pembentukan Peraturan Perundang-undangan Indonesia", Saturday (20/2).
This webinar presents Prof. Dr. Satya Arinanto, SH, MH, Professor of Law, Faculty of Law, University of Indonesia, who is also the Special Staff of the Indonesian Vice President for Law, as speaker and guided by Dr. Dra. Fennieka Kristianto, S.H., M.H., M.A., M.Kn, Head of Law Study Program, PresUniv. Prof. Satya emphasized that the omnibus law is not new in Indonesia. “From 1819 to 1949, the Dutch colonial government enforced seven thousand regulations, which after 1949 were simplified to 400 regulations. This is actually an omnibus law, but at that time there was no such term,” he said.
According to Prof. Satya, currently the omnibus law is the best method to simplify and change regulations to keep pace with the times. "In the future, all regulations can be changed by this method. Because if they change them one by one it will take a long time,” he added. He said, there were still differences of opinion and political views among experts regarding the omnibus law. At the end of the webinar, Prof. Satya asked the participants to read in detail the regulations that had been simplified by the omnibus law method, including those that could potentially be omnibus-lawed. Omnibus Law: Metode Terbaik Pembentukan UU di Indonesia
Minggu, 20 Oktober 2019, saat pidato pelantikannya, Presiden Joko Widodo (Jokowi) mengungkapkan inisiatif “baru” untuk membentuk omnibus law. Sejatinya, omnibus law bukan sekadar nama, tetapi suatu metode dalam pembentukan suatu peraturan. Untuk memahami lebih lanjut mengenai metode ini, Program Studi (Prodi) Hukum, President University (PresUniv), mengadakan webinar “Omnibus Law sebagai Metode Pembentukan Peraturan Perundang-undangan Indonesia”, Sabtu (20/2).
Webinar ini menghadirkan pembicara Prof. Dr. Satya Arinanto, SH, MH, Guru Besar Ilmu Hukum, Fakultas Hukum, Universitas Indonesia, yang juga Staf Khusus Wakil Presiden RI Bidang Hukum, dan dipandu oleh Dr. Dra. Fennieka Kristianto, S.H., M.H., M.A., M.Kn, Kepala Prodi Hukum, PresUniv. Prof. Satya menegaskan, omnibus law bukanlah hal baru di Indonesia. “Pada 1819 sampai 1949, Pemerintah Kolonial Belanda telah memberlakukan tujuh ribu peraturan, yang setelah 1949 disederhanakan menjadi 400 peraturan. Ini sebetulnya omnibus law, hanya pada waktu itu belum ada istilah tersebut,” ujarnya.
Menurut Prof. Satya, saat ini omnibus law adalah metode terbaik untuk menyederhanakan dan mengubah peraturan agar selaras perkembangan zaman. “Di masa mendatang, semua peraturan bisa diubah dengan metode ini. Sebab jika mengubahnya satu persatu akan membutuhkan waktu lama,” tambahnya. Katanya, memang masih ada perbedaan perbedaan pendapat dan pandangan politik di antara para ahli tentang omnibus law. Pada akhir webinar, Prof. Satya mengajak para peserta untuk bersama-sama membaca secara rinci peraturan-peraturan yang telah mengalami penyederhanaan dengan metode omnibus law, termasuk yang berpotensi di-omnibus-law-kan. “Ini bisa menjadi topik riset yang menarik,” pungkasnya.
