Cikarang, Indonesia – On Thursday (19/10), President University hosted Prof. Tim Murphy from University Carlos III de Madrid, Spain who gave a lecture to over 100 Law students about the “Alternative Dispute Resolution and Authority of Customary (Adat) Law”. He is a lecturer of International Law, Ecclesiastical Law (a law that governs the affairs of Christian church) and Philosophy of Law. Prof. Murphy is also an expert in Social and Political Philosophy, Ethics, and Public Law.

On his lecture, he explained about the traditional common rule or practice that has become an intrinsic part of the accepted and expected conducts in a community, profession, or trade and is treated as a legal requirement. He also provided many examples and case studies of comparative Adat Law in each country especially in Spain and Indonesia to further deepen his discussion of the law.

According to him, there was a principal or basic idea of an Adat Law that came from the term of contract law in Latin “Pacta Sunt Ser Vada” which means agreements (promises) must be kept. According to him, there will be no community without that rule.

“The students were great along with their questions. They were enthusiastic and I was very happy. I can see that there was a lot of interest in the subject”, said Prof. Murphy. (YE)


Belajar dari Ahli Hukum Adat: Prof. Tim Murphy dari University Carlos III de Madrid, Spain

Cikarang, Indonesia – Pada Hari Kamis (19/10), President University menjamu Prof. Tim Murphy dari Universitas Carlos III de Madrid, Spanyol, memberikan kuliah tamu kepada lebih dari 100 mahasiswa Hukum tentang Alternatif Penyelesaian Sengketa dan Kewenangan Hukum Adat. Ia merupakan seorang dosen Hukum Internasional, Ecclesiastical Law (Hukum Gerejawi), dan Filsafat Hukum. Prof. Murphy juga merupakan seorang ahli dalam Filsafat Sosial, Filosofi, Etika, dan Hukum Publik.

Dalam kuliah tamunya, dia menjelaskan tentang peraturan umum atau praktik tradisional yang telah menjadi bagian hakiki dari perilaku yang diterima dan diharapkan dalam komunitas, profesi, atau perdagangan yang diberlakukan sebagai persyaratan hukum. Ia juga memberikan banyak contoh dan studi kasus tentang Hukum Adat di masing-masing negara, terutama di Spanyol dan Indonesia, untuk memperdalam pembahasannya mengenai Hukum Adat.

Menurutnya, ada gagasan pokok atau dasar Hukum Adat yang berasal dari istilah hukum kontrak yang dalam bahasa Latin yaitu "Pacta Sunt Ser Vada" yang berarti perjanjian (janji) harus dijaga. Menurutnya, masyarakat tidak akan bisa terbentuk tanpa adanya peraturan tersebut.
